Rhett Baumgartner Commercial Real Estate (“Broker”) is a full service commercial real estate company in the business of acting as an agent for Clients interested in buying, selling, or leasing commercial real estate. Additionally, Broker provides Customer Services to Customers.

A “Customer” is a person or entity who is provided Customer Services in the ordinary course of business by Broker but who is not a Client. Broker may provide certain services to Customers without entering into an agency relationship with that Customer. “Customer Services” are those services that Broker may provide to a Customer that are informative in nature and do not rise to the level of active representation. Examples of these include, but are not limited to:

  1. responding to telephone inquiries by Customers as to the availability and pricing of real estate services;
  2. responding to telephone inquiries from a Customer concerning the price, location or amenities of any property;
  3. responding to questions about a property from a Customer;
  4. setting an appointment to show property;
  5. responding to questions of Customers walking into Broker’s office concerning real estate services offered or particular properties;
  6. arranging for lenders, attorneys, inspectors, appraisers, insurance agents, surveyors or other service providers;
  7. accompanying an appraiser, inspector, contractor or similar third party on a visit to a property;
  8. describing a property’s physical condition in response to a Customer inquiry;
  9. completing business or factual information for a Customer on an offer to purchase or lease on behalf of a client of Broker; or
  10. referral to another licensee.

Broker has no legal duties or obligations to a Customer, except that Broker shall treat all Customers honestly and shall not knowingly give Customers false information. Any information received from Customers will not be regarded as confidential. Unless a party has entered into a written agency agreement with Broker, the party shall be deemed to be a Customer.

A “Client” is a person or entity who has entered into a written agency relationship with Broker. Broker owes duties of trust, loyalty, confidentiality, accounting and disclosure to the Client. The most common types of agency relationships between Broker and a Client include (1) representing the seller or landlord seeking to sell or lease property; (2) representing the buyer or tenant seeking to buy or lease property; or (3) representing both the seller and buyer or both the landlord and tenant. Before representation is accepted by Broker, Broker and a Client must enter into a written agreement setting forth the terms and conditions of their agency relationship. Unless a party has entered into a written agency agreement with Broker, the party shall be deemed to be a Customer.
